Personal data is individual information about personal or factual circumstances of a specific or identifiable natural person.

Legal basis

We collect and process personal data on the basis of the following legal principles:

– Consent in accordance with Article 6 paragraph 1 lit.a of the Basic Data Protection Regulation (DSGVO). Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State in which you are domiciled, your place of work or the place where the alleged infringement occurred, if you consider that the processing of personal data relating to you is in breach of the DPA.

Data erasure and storage duration

The personal data of the person concerned will be deleted or blocked as soon as the purpose of the storage is no longer applicable. Furthermore, data may be stored if this has been provided for by the European or national legislature in Union regulations, laws or other regulations to which the person responsible is subject. Data is also blocked or deleted when a storage period prescribed by the aforementioned standards expires, unless there is a need to continue storing the data for the purpose of concluding or fulfilling a contract.

2. Concrete data processing (data collection when visiting the website)

Scope of data processing

When you visit our website, the following data is recorded and stored by our web server:

The data is stored in the log files of our system. This data is not stored together with other personal data of the user. This data is collected and stored by our hosting provider 1&1 Internet SE.

Legal basis

The legal basis for the data processing is Art. 6 para. 1 lit. f DSGVO. The legal basis for the processing by our hosting provider is Art. 28 para. 3 DSGVO.

The legitimate interest within the meaning of Art. 6 Para. 1 lit. f DSGVO is therefore in the functionality of our website and its availability.

Purpose of data processing

The temporary storage of the IP address by the system is necessary to enable the website to be delivered to the user’s computer. For this purpose, the user’s IP address must remain stored for the duration of the session.

The data is stored to ensure the functionality of the website. In addition, the data is used to optimise the website and to ensure the security of our information technology systems. An evaluation of the data for marketing purposes does not take place in this context.

Duration of storage

The IP addresses will be anonymised after seven days at the latest, unless there is a need to keep the data for the above-mentioned purpose due to concrete events.

Storage beyond this is possible. In this case, the IP addresses of the users are alienated, so that it is no longer possible to assign the data to a specific user.

Possibility of objection and removal

The collection of data for the provision of the website and the storage of the data in log files is mandatory for the operation of the website. There is therefore no possibility of objection on the part of the user.

3. Contact form

3.1. Scope of data processing

On the website there is a contact form which can be used for electronic contact. If you enter data in the input fields, these are transmitted to us and stored. The data include: name, company, e-mail address, telephone number if applicable, the nature of the request and the individual message to us. In addition, the date and time of the message is automatically recorded.

Alternatively, it is possible to contact us via the provided e-mail address. In this case, the user’s personal data transmitted with the e-mail will be stored.

3.2. legal basis

The legal basis for the processing of data transmitted in the course of sending an e-mail is Art. 6 Par. 1 letter f and, if applicable, also letter a of the DSGVO. If the e-mail contact is aimed at the conclusion of a contract, an additional legal basis for the processing is Art. 6 para. 1 lit. b or lit. c DSGVO in connection with general obligations to retain business letters.

The legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO lies in answering a customer enquiry or answering a contact enquiry on other topics.

3.3. Purpose of data processing

The purpose of data storage is to establish contact at the request of the communication partner.

3.4. Duration of storage

The data will be stored for as long as necessary to complete the request. As far as this concerns commercial letters which have to be kept according to commercial and tax law, they will be stored beyond that according to the legal retention periods.

3.5. Possibility of objection and removal

You have the possibility at any time to revoke your consent to the processing of personal data with effect for the future or to object to any further use. Data can only be deleted if there is no legal retention period and no other reason for storage; in this case, however, the data will be blocked for any other use. In such a case, the conversation cannot be continued.

4. Datenlöschung und Speicherdauer

Die personenbezogenen Daten der betroffenen Person werden gelöscht oder gesperrt, sobald der Zweck der Speicherung entfällt. Eine Speicherung kann darüber hinaus dann erfolgen, wenn dies durch den europäischen oder nationalen Gesetzgeber in unionsrechtlichen Verordnungen, Gesetzen oder sonstigen Vorschriften, denen der Verantwortliche unterliegt, vorgesehen wurde. Eine Sperrung oder Löschung der Daten erfolgt auch dann, wenn eine durch die genannten Normen vorgeschriebene Speicherfrist abläuft, es sei denn, dass eine Erforderlichkeit zur weiteren Speicherung der Daten für einen Vertragsabschluss oder eine Vertragserfüllung besteht.

1. Datenverarbeitung durch Instagram

Unser Instragam Profil wird über den Dienst Instagram der Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland bereitgestellt. Facebook kann wie folgt kontaktiert werden:

Facebook erhebt bei der Betrachtung und Kommentierung von Instagram Profilen – also auch bei der Betrachtung und Kommentierung unseres Instagram Profils im Rahmen des Gewinnspiels – durch angemeldete Kunden verschiedene Daten, insbesondere die IP Adresse, die betrachteten Inhalte, die verwendeten Geräte etc. Facebook informiert hier über die Datenverarbeitung bei Instagram:

Wir selbst haben keinerlei Zugang zu diesen Daten in personenbezogener Form, noch sind wir in der Lage die Datenverarbeitung durch Instagram zu beeinflussen.

 2. Datenerhebung bei der Teilnahme am Gewinnspiel

a) Umfang der Datenverarbeitung

Wir erheben die Nutzernamen Teilnehmer am Gewinnspiel. Hierfür werden die Nutzernamen erfasst, die einen Kommentar unter dem Gewinnspiel-Betrag hinterlassen haben. Die Daten werden bei uns elektronisch erfasst und auf angemieteten Servern gespeichert. Unser Hostinganbieter hat seinen Sitz in Deutschland und speichert die Daten ausschließlich innerhalb der europäischen Union.

Von den Gewinnern werden anschließend die Echtnamen sowie die Anschrift erfasst. Name und Anschrift der Gewinner werden für die Auslieferung der Preise an den Friseur/-betrieb weitergeleitet, die den jeweiligen Preis gestellt haben. Sämtliche Friseure/-betriebe haben ihren Sitz in Deutschland.

b) Rechtsgrundlage

Rechtsgrundlage für die für die Verarbeitung der Daten und die Weitergabe an die Friseure/-betriebe ist Art. 6 Abs. 1 lit. b DSGVO. Grundlage für die Verarbeitung durch unseren Hosting-Anbieter ist Art. 28 Absatz 3 DSGVO.

c) Zweck der Datenverarbeitung

Die Erhebung und Verarbeitung der Daten erfolgt, um das Gewinnspiel durchzuführen und die Auslieferung der jeweiligen Preise zu ermöglichen.

d) Dauer der Speicherung

Die Nutzernamen der Teilnehmer werden solange vorgehalten, bis uns von allen Gewinnern die Anschrift vorliegt und somit keine Nachrücker auf die Gewinnerplätze mehr anfallen können. Name und Anschrift der Gewinner werden bis zu 6 Monaten nach Ablauf der Verjährung etwaiger Ansprüche aus dem Gewinnspiel allein für den Zweck des Nachweises der Vertragserfüllung und der angemessenen Rechtsverteidigung gespeichert und danach gelöscht.

e) Widerspruchs- und Beseitigungsmöglichkeit

Soweit Sie einer Nutzung der Daten vor dem Ende des Gewinnspiels widersprechen, werden wir ihren Teilnahmebeitrag löschen. Damit nehmen Sie auch nicht mehr am Gewinnspiel teil. Danach dient die Verarbeitung der Vertragserfüllung, so dass kein Widerspruchsrecht gegeben ist.

• Dieses Gewinnspiel steht in keiner Verbindung zu Facebook (Instagram) und wird in keiner Weise von Facebook (Instagram) gesponsert, unterstützt oder organisiert. Der Empfänger der von dir bereitgestellten Informationen ist nicht Facebook (Instagram), sondern 99pro.
• Gegenstand des Gewinnspiels ist die Verlosung von Friseurprodukten.
• Teilnahmeberechtigt sind alle unbeschränkt geschäftsfähigen Personen, die das 16. Lebensjahr vollendet haben und einen Wohnsitz in Deutschland haben. Teilnehmerinnen und Teilnehmer aus anderen Ländern sind nicht teilnahmeberechtigt.
• Beschäftigte von 99pro und deren Angehörige, sowie Friseure von “Einfach Hairlich” und deren Angehörige sowie Mitarbeiter, sind von der Gewinnspielteilnahme ausgeschlossen.
• Um an dem Gewinnspiel teilnehmen zu können, muss der Teilnehmer über ein eigenes Instagram Profil verfügen.
• Der Gewinnspielzeitraum startet am 01.12.2019 um 09:00 Uhr und endet am 24.12.2019 um 20:00 Uhr.  Jeden Tag wird eine Verlosung gestartet, welche nach 24 Stunden (immer von 9:00 Uhr bis 8:59 Uhr des nächsten Tages) endet (“Gewinnspielende”).
• Die Teilnahme erfolgt entsprechend den jeweiligen Vorgaben der Produktionsfirma. Entweder in der Form von Sharing, Markierung Dritter oder Kommentierung über die Kommentarfunktion von Instagram.
• Mit Abgabe eines Kommentars auf den oben genannten Instagram-Post akzeptiert der Teilnehmer die vorliegenden Teilnahmebedingungen.
• Jeder Teilnehmer darf nur einmal an dem Gewinnspiel teilnehmen. Mehrere Kommentare werden als eine einzelne Teilnahme gewertet.
• Der Teilnehmer verpflichtet sich, keine Kommentare abzugeben, die gegen die Facebook/Instagram-Richtlinien, deutsches Recht und oder das Urheberrecht verstoßen.
• 99pro behält sich vor, Kommentare, die gegen die Facebook/Instagram-Richtlinien, deutsches Recht oder das Urherberrecht verstoßen, nach Kenntnisnahme ohne Ankündigung zu entfernen. Der Teilnehmer ist damit von der Gewinnspielteilnahme ausgeschlossen.
• 99pro behält sich des Weiteren vor, Teilnehmer zu disqualifizieren, die gegen die Teilnahmebedingungen oder die guten Sitten verstoßen oder versuchen, die Verlosung zu manipulieren.
• 99pro behält sich das Recht vor, das Gewinnspiel anzupassen, zu ändern oder abzubrechen, falls eine ordnungsgemäße Durchführung aus technischen oder rechtlichen Gründen nicht mehr gewährleistet werden kann.
• Die Gewinner werden binnen 3 Tagen nach Gewinnspielende per Losverfahren ermittelt.
• Die Gewinner werden binnen 1 Tag nach Gewinnspielende mittels Instagram-Direct über ihren Gewinn informiert.
• Die Gewinner müssen innerhalb von 3 Tagen nach Erhalt der Gewinnbenachrichtigung 99pro ihre postalische Anschrift mittels Instagram-Direct zukommen lassen. Geschieht dies nicht verfällt der Gewinn und ein Ersatzgewinner wird durch Los ermittelt.
• Die Sachpreise werden per Post an die Gewinner versendet. Eine Barauszahlung des Gewinns ist nicht möglich.
• 99pro haftet nicht für die technische Erreichbarkeit oder Durchführbarkeit des Gewinnspiels.
• Der Rechtsweg ist ausgeschlossen.

• Teilnahmeberechtigt sind alle unbeschränkt geschäftsfähigen Personen, die das 16. Lebensjahr vollendet haben und einen Wohnsitz in Deutschland haben. Teilnehmerinnen und Teilnehmer aus anderen Ländern sind nicht teilnahmeberechtigt.
• Beschäftigte von 99pro und deren Angehörige, sowie Brautausstatter von “Zwischen Tüll und Tränen” und deren Angehörige sowie Mitarbeiter, sind von der Gewinnspielteilnahme ausgeschlossen.
• Um an dem Gewinnspiel teilnehmen zu können, muss der Teilnehmer über ein eigenes Instagram Profil verfügen.
• Der Gewinnspielzeitraum startet am 01.12.2019 um 10:00 Uhr und endet am 31.12.2019 um 20:00 Uhr und beinhaltet 6 Gewinnspiele, welche jeweils ab der Veröffentlchung des Postings 72 Stunden andauern.
• Die Teilnahme erfolgt entsprechend den jeweiligen Vorgaben der Produktionsfirma. Entweder in der Form von Sharing, Markierung Dritter oder Kommentierung über die Kommentarfunktion von Instagram.
• Mit Abgabe eines Kommentars auf den oben genannten Instagram-Post akzeptiert der Teilnehmer die vorliegenden Teilnahmebedingungen.
• Jeder Teilnehmer darf nur einmal an dem Gewinnspiel teilnehmen. Mehrere Kommentare werden als eine einzelne Teilnahme gewertet.
• Der Teilnehmer verpflichtet sich, keine Kommentare abzugeben, die gegen die Facebook/Instagram-Richtlinien, deutsches Recht und oder das Urheberrecht verstoßen.
• 99pro behält sich vor, Kommentare, die gegen die Facebook/Instagram-Richtlinien, deutsches Recht oder das Urherberrecht verstoßen, nach Kenntnisnahme ohne Ankündigung zu entfernen. Der Teilnehmer ist damit von der Gewinnspielteilnahme ausgeschlossen.
• 99pro behält sich des Weiteren vor, Teilnehmer zu disqualifizieren, die gegen die Teilnahmebedingungen oder die guten Sitten verstoßen oder versuchen, die Verlosung zu manipulieren.
• 99pro behält sich das Recht vor, das Gewinnspiel anzupassen, zu ändern oder abzubrechen, falls eine ordnungsgemäße Durchführung aus technischen oder rechtlichen Gründen nicht mehr gewährleistet werden kann.
• Die Gewinner werden binnen 3 Tagen nach Gewinnspielende per Losverfahren ermittelt.
• Die Gewinner werden binnen 1 Tag nach Gewinnspielende mittels Instagram-Direct über ihren Gewinn informiert.
• Die Gewinner müssen innerhalb von 3 Tagen nach Erhalt der Gewinnbenachrichtigung 99pro ihre postalische Anschrift mittels Instagram-Direct zukommen lassen. Geschieht dies nicht verfällt der Gewinn und ein Ersatzgewinner wird durch Los ermittelt.
• Die Sachpreise werden per Post an die Gewinner versendet. Eine Barauszahlung des Gewinns ist nicht möglich.
• 99pro haftet nicht für die technische Erreichbarkeit oder Durchführbarkeit des Gewinnspiels.
• Der Rechtsweg ist ausgeschlossen.
